## Education and qualifications

### Geology PhD and technical leadership with project-development history [bmc_neil_education]

Career through 2026-10-09 · issuer reported · medium materiality

BMC’s leadership page lists a Geology PhD and MAIG. The historical BMC project proposal describes nearly 30 years in exploration and mining, a University of Tasmania/CODES PhD, prior exploration-management and chief-geologist roles, and project experience. The FY2026 annual report confirms Martin as a Competent Person and Member of the Australian Institute of Geoscientists; it also states his technical review/approval role for the resource/reserve disclosure. Dates and university award confirmation were not independently verified.

**Attribution:** Responsibility not applicable. BMC biography and filings support the profile; no independent degree-register check was performed.

**Relevance:** Strong relevance to the technical and exploration remit at a pre-construction VMS project.

## Contributions and company outcomes

### Technical disclosure and current exploration progress are documented; individual discovery attribution remains limited [bmc_neil_project_delivery]

2014 to 2026-10-30 · issuer reported · medium materiality

BMC’s 26 October 2026 quarterly report identifies Martin as the Competent Person who reviewed the technical information. The 30 October update reports 15 Rhyolite Peak drill holes, 10 with massive-sulphide intersections and additional assay results; mineralization remains open and the company says further drilling is needed. The separate quarterly report records approximately 19,000 m of a 20,000 m 2026 program completed by 30 September and FID targeted for late 2027 subject to permits and technical studies. These records document technical review and project progress, not sole discovery credit, construction or mine production.

**Attribution:** Individual involvement documented. The quarterly report directly documents Martin’s technical review. The disclosures do not assign him sole responsibility for discovery, exploration results, permitting, financing or the future project decision.

**Relevance:** Relevant to technical leadership and exploration; the project remains pre-construction and dependent on permits and funding.

## Litigation and enforcement

### KZK court challenge produced a limited consultation remedy, later followed by a positive assessment decision [bmc_neil_kzk_legal]

2022 to 2026-11-02 · documented · medium materiality

The Yukon Supreme Court found a limited Crown duty-to-consult failure concerning a June 2022 submission and set aside the project Decision Document for further consultation on that issue. The Yukon Court of Appeal later ordered further consultation on the project’s economic viability. These were findings about government consultation duties; they do not establish a breach or personal wrongdoing by BMC or Martin. Martin is documented as a founding BMC director and long-serving technical leader, so the dispute overlapped company leadership, but no individual causal role was found. BMC reports a positive April 2026 Decision Document; remaining licences are still required. In a separate procedural step, BMC applied in March 2025 for court-set consultation and decision deadlines; the Court of Appeal dismissed the application without prejudice to seeking reopening before the panel. In April 2026, the government issued a positive new Decision Document after further consultation. BMC’s September 2026 annual report subsequently disclosed receipt of a Type B Water Licence and a five-year Class 3 Quartz Mining Land Use Approval after year-end. BMC’s 2 November 2026 updated feasibility study now forecasts after-tax NPV5 of US$1.696 billion, 54% IRR and 1.4-year payback from processing, but those are issuer forecasts and no construction decision or funding is in place. The 25-year Type B Water Licence and five-year Class 3 land-use approval were received in July; the Type A Water Licence, Quartz Mining Licence, Fisheries authorization and ancillary permits remain, financing and FID are pending, and the issuer targets late 2027 FID subject to permits and further technical studies.

**Attribution:** Role overlaps event; causation unproven. The courts identify Crown decision bodies’ consultation failure; the available decisions do not assign responsibility to Martin.

**Relevance:** Material to oversight of project development and permitting, with partial resolution but remaining licensing dependencies.
