## Industrial safety

### Henty contractor fatality and mine owner conviction [sky_todd_henty]

January 2020 incident; conviction reported in July 2025 coronial finding (conviction date not established) · documented · high materiality

On 23 January 2020 a PYBAR employee died after ground collapsed beneath his loader at Tasmania’s Henty mine. The 2025 coroner’s finding records that Unity Mining, the mine owner, pleaded guilty to a safety-duty offence and was fined A$150,000. PYBAR’s newsletter identifies the worker as its employee.

**Attribution:** Role overlaps event; causation unproven. PYBAR announced Todd as COO in 2017 and its replacement COO from July 2020. Those records support temporal role overlap but do not establish his involvement in Henty or personal fault. The conviction was against Unity Mining, not Todd or PYBAR.

**Relevance:** Prior employer safety context is relevant to evaluating oversight and management experience.

## Litigation and enforcement

### PYBAR and Challenger commercial dispute [sky_todd_wpg]

2017–2019 · disputed · medium materiality

WPG’s March 2018 filing for the half-year ended December 2017 says PYBAR sought A$9.6 million including GST in unpaid contract claims; Challenger Gold Operations disputed them and asserted an offset. In 2018 the Supreme Court refused PYBAR limited leave to pursue an interlocutory strike-out application while Challenger was in administration; the judge did not decide the underlying claim or counterclaim. The 2019 administrators’ report records PYBAR disputed the claimed responsibility for underperformance and describes an unsigned settlement draft. The final merits disposition was not located.

**Attribution:** Role overlaps event; causation unproven. The dispute arose during Todd’s reported PYBAR COO role. The sources do not establish that he was personally involved or responsible.

**Relevance:** Material former-employer commercial and contractual context.

## Evidence gaps

- Exact start and end dates for COO/CCO roles and prior Mitsubishi, Thiess and North Harbour engagements remain incomplete.

- Original Unity Mining sentencing judgment and full PYBAR/Challenger final court disposition were not located; a 2025 primary coroner finding and 2019 administrator account were opened.

- No independent credential verification or comprehensive targeted person/employer searches across all required adverse topics were completed.

- Individual role at Henty and in the Challenger dispute is not established; corporate outcome must not be attributed as his personal misconduct.

- Retrospective search-log audit relied on the contemporaneous research checkpoint; the original tool-call transcript was unavailable to this audit, so exact query execution could not be independently reverified.
