Mount Polley tailings role and documented warning

2012–2015 · documented · high materiality

The BC chief inspector’s report says tailings-facility responsibilities devolved to Moger and other water-management personnel in 2012 and identifies unclear responsibilities and diffuse water-management accountability. The tailings dam breached in August 2014. It records that Moger did not see a concern with an unfilled toe excavation, while acknowledging that such an excavation would reduce the factor of safety. Contemporary reporting also says he warned in a 2013 liaison meeting that rising tailings water required action.

Attribution: Individual involvement documented. The source establishes a specific role and records his account of the excavation, while the investigation describes organizational and engineering factors; it does not establish individual legal culpability for the breach. His reported warning is included as relevant context.

Relevance: The former tailings role and subsequent investigation are material to environmental and project oversight.

Governance and interests

2018 professional-title undertaking

2011–2024 · documented · high materiality

In a signed 2018 undertaking with Engineers and Geoscientists BC, Moger agreed that between 2011 and 2016 he used the titles project engineer and mining engineer while not registered with or licensed by the association, that this breached the then Act, and that he stopped promptly when notified. NexGen’s 2024 environmental statement later describes him as a professional engineer; the date and current status of any registration were not independently established.

Attribution: Individual involvement documented. The undertaking records Moger’s own agreed conduct and response. It does not find that this caused the Mount Polley breach, and it does not establish his later or current registration status.

Relevance: Directly relevant to professional-title and licensing diligence for the current permitting role.

Rook I site-preparation violation and later licence

2023–2026 · documented · high materiality

The CNSC determined that NexGen conducted site-preparation work without the required licence, and corrected the penalty to C$11,920. It later granted a construction licence in March 2026; this did not authorize operations. NexGen had contested the classification of the earlier work as site preparation.

Attribution: Role overlaps event; causation unproven. Moger held NexGen’s permitting role during the process; the finding is against NexGen and does not attribute individual misconduct.

Relevance: Directly relevant regulatory context for the current permitting role.

Suitability for the current role

Environmental permitting and mine project experience

Issuer-reported career through 2026 · analyst inference · low materiality

NexGen identifies Moger as the environmental permitting and licensing VP and reports prior Mount Polley and Red Chris management experience. The provincial investigation documents his specific Mount Polley tailings role.

Attribution: Responsibility not applicable. Role relevance is an analyst inference; issuer descriptions do not establish individual causation or credential validity.

Relevance: Relevant to the assigned management role; evidence remains limited.

Evidence gaps

  • Independent verification of qualifications, complete career dates, prior-employer outcomes and comprehensive regulator/court records is incomplete.

  • The documented name-and-employer search is a limited open-web screen and is not criminal, sanctions or litigation clearance.

  • Current independent engineering register status and any later individual investigation outcomes were not independently verified.

  • Original liaison committee minutes underlying the 2013 warning were not retrieved; the warning is cited to independent reporting.
